Terms of Service

These terms are the agreement between you and us for using the Throw app. Please read them. By creating an account you accept them.

1. Who we are

Throw is operated by My Task Master Ltd, trading as Throw, a company registered in England and Wales (company number 16878946). Registered office: Flat 93 March Court, Warwick Drive, London, England, SW15 6LD.

You can reach us at support@mbo9.com. "We", "us" and "our" mean My Task Master Ltd. "You" means the person using Throw.

2. What Throw is

Throw is software that helps a group of people who already know each other run a rotating savings circle (also called a Partner, Susu, Ajo, Pardna or Tontine). The group agrees an amount and a schedule. Each cycle, every member pays the agreed amount to the member whose turn it is to receive. Throw keeps the schedule, the payout order, reminders, receipts and the record of who has paid.

Throw is not a bank and is not authorised or regulated by the Financial Conduct Authority. In pound sterling (GBP) circles Throw does not hold, pool, transfer or lend your money, and does not run a wallet. Every contribution moves directly from your bank account to the receiving member’s bank account.

Because Throw never holds your money, there is no Financial Services Compensation Scheme (FSCS) cover for anything you pay through Throw. A circle relies on its members. Another member may pay late or stop paying, and if that happens you may receive less than expected or nothing in a cycle. Throw does not guarantee that other members will pay and does not promise, insure or top up any payout.

3. Payments are made through Yapily

When you pay a contribution, the bank transfer is started by Yapily Connect Ltd, which is authorised by the Financial Conduct Authority as a payment initiation service provider (Firm Reference Number 827001). You give Yapily an instruction to pay the receiving member from your own bank account, and Yapily passes that instruction to your bank. Throw shows you Yapily’s status for that payment.

Your use of Yapily’s service is governed by Yapily’s End User Terms, which you accept when you make a payment. Yapily is responsible for the payment initiation service, and complaints about how a transfer was initiated go to Yapily.

Throw is not a party to the payment. Throw cannot cancel, reverse or refund a transfer once your bank has sent it. If you paid the wrong person or the wrong amount, contact your bank and the receiving member.

4. Who can use Throw

You must be at least 18 years old, live in the United Kingdom and have a UK bank account in your own name that supports Open Banking. You must give us accurate details and keep them up to date. You may hold one account.

You may only join a circle whose members you know and trust. Throw is not a marketplace and we do not introduce members to each other.

5. Fees

Throw charges a transfer and processing fee of £1.00 for each contribution you make in a single-currency circle. In a multi-currency circle, where that feature is available, the fee is £1.20 if you pay in the circle’s currency and £1.50 if you pay in a different currency.

The fee is charged to a payment card you save with Stripe, our card processor. It is charged separately, so the receiving member always gets the full contribution. The fee and the total you will pay are shown on screen before you confirm.

Once the bank transfer has been initiated the fee is non-refundable, because the processing it pays for has been carried out. If the transfer fails before it is initiated we refund or do not take the fee. There are no subscription charges, and there is no charge for creating a circle, joining a circle or receiving a payout.

Any promotional credits we give you can only be used against this fee. They have no cash value and cannot be transferred.

6. Your responsibilities as a member

When you join a circle you accept its rules: the amount, the frequency, the payout order and the late-payment policy set by the organiser. You agree to pay each contribution in full and on time, for every cycle, until the circle completes, including after you have received your own payout.

You must keep the bank details you use to receive payouts accurate. Other members pay you at the account details you enter; if they are wrong, the money may be lost and Throw cannot recover it.

You must only pay with money that is legally yours. You must not use Throw for money laundering, fraud, tax evasion or anything else illegal, and you must not use it on behalf of someone else without telling us.

If you leave a circle before it completes, you remain responsible for what you agreed to pay under its rules, and other members may pursue you directly for it.

7. Organisers

The organiser creates the circle, sets its rules, invites members, sets the payout order and decides how late payments are handled under the late-payment policy shown to every member before they join.

The organiser is a member like any other and is not our agent or employee. The organiser does not hold or control anyone’s money. We may remove an organiser or close a circle if we believe it is being used dishonestly or in breach of these terms.

8. Problems between members

Throw includes a dispute tool that lets a member flag an issue in a circle, notify the other members and keep a record of what was said and decided. Members and the organiser use it to resolve the issue between themselves.

Throw is not an arbitrator, mediator or court. We do not decide who is right, we do not compel a member to pay and we do not pay anyone on a member’s behalf. If a member does not pay, your remedy is against that member. Where the law allows, we will provide records from the circle to support a claim.

9. Identity checks

To protect members and to meet our partners’ requirements we may ask you to verify your identity before you can receive a payout, for example by taking a photo of an identity document. We may suspend payouts or your account until a check is complete, and we may refuse or close an account if a check fails or if we suspect illegal activity.

10. Your right to cancel

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you may cancel this agreement within 14 days of creating your account, without giving a reason. Email us at the address below or delete your account in the app.

Each time you pay a contribution you ask us to start the transfer service straight away. If you cancel after a transfer has been initiated, the fee for that transfer is not refundable because the service has already been fully performed. Cancelling your agreement with us does not cancel what you owe the other members of a circle you joined.

11. Closing your account

You can delete your account at any time from your profile. Deleting removes your personal details and signs you out for good. We keep transaction records for as long as the law requires (see the Privacy Policy) and other members keep the circle history they already have.

We may suspend or close your account if you break these terms, if the law requires it, if a partner such as Yapily or Stripe requires it, or if we stop offering Throw. Where we can, we will tell you in advance and give you time to complete an active circle.

12. Complaints

If something has gone wrong, email support@mbo9.com with the word “Complaint” in the subject line and tell us what happened. We will acknowledge your complaint within 3 business days and give you a full response within 15 business days. If we need longer we will tell you why and when to expect an answer.

Throw is not regulated by the Financial Conduct Authority, so the Financial Ombudsman Service cannot consider complaints about Throw itself. Complaints about the bank transfer service (for example a payment initiated incorrectly) should go to Yapily Connect Ltd, which is FCA-regulated; if you are unhappy with Yapily’s response you may be able to take that complaint to the Financial Ombudsman Service. Complaints about your card charge can also be raised with your card issuer.

13. Our responsibility to you

We will provide Throw with reasonable care and skill. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law does not allow us to limit.

Otherwise, we are not responsible for: another member paying late or not at all; a bank or payment provider delaying, rejecting or misdirecting a transfer; losses caused by details you entered incorrectly; or losses that we could not reasonably have expected when you accepted these terms. Our total liability to you for everything arising out of your use of Throw in any 12-month period is limited to the fees you paid us in that period.

Throw is provided for personal use. We are not liable for business losses.

14. Changes to these terms

We may change these terms to reflect changes in the law, in our partners’ requirements or in how Throw works. We will tell you in the app at least 14 days before a material change takes effect. If you keep using Throw after that date you accept the new terms; if you do not agree, you can close your account before it.

15. General

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction, although if you live in Scotland or Northern Ireland you may also bring a claim in your local courts. If any part of these terms is found to be unenforceable the rest still applies. We may transfer our rights under these terms to another company that takes over Throw, provided your rights are not reduced.

The app software, the Throw name and our designs belong to us. We give you a personal, non-transferable licence to use the app on your own devices for its intended purpose.
